This appeal is taken from a judgment of nonsuit. Plaintiff, a Negro, received personal injuries in a fall from a moving train upon which he was a passenger. In reciting the evidence we shall be mindful of the rule, so frequently restated that any supporting citation would be superfluous, that we must consider the evidence most favorable to plaintiff, together with every favorable inference which can be reasonably drawn therefrom, without attempting to evaluate the weight to be given to conflicting or contradictory testimony.
